Privacy Policy of LLC “EVROTEKHNOLOGII”

1. General Provisions

1.1. This Privacy Policy (hereinafter referred to as the “Policy”) has been developed and is applied by the Limited Liability Company “Evrotekhnologii” (hereinafter referred to as the “Company”) with respect to information containing Users’ personal data collected and processed through the official website located at: melenni.com (hereinafter referred to as the “Website”).

1.2. The Policy defines the procedure and conditions for processing Users’ personal data, measures to ensure their security, as well as the rights and obligations of the Users and the Company related to the processing of personal data.

1.3. This Policy is informational in nature and sets out the procedure for processing Users’ personal data when using the Website. Where the legislation of the Russian Federation requires the User’s consent for the processing of personal data, such consent is provided separately by the User through the relevant action available on the Website. Personal data necessary for placing an order and for entering into and performing a sales agreement is processed by the Company for the purposes of entering into and performing such agreement.

1.4. The processing of personal data by the Company is carried out in strict compliance with the legislation of the Russian Federation, primarily Federal Law No. 152-FZ dated July 27, 2006 “On Personal Data”.

2. Scope of Personal Data

2.1. For the purposes of this Policy, personal data means any information relating to an identified or identifiable individual (User).

2.2. The Company may process the following personal data of the User:

• surname, first name and patronymic;
• gender, where such information is provided by the User or is contained in information related to the use of the Website or placement of an order;
• contact telephone number;
• email address;
• delivery address;
• order information, including the order number, contents and status;
• information about the selected delivery method;
• comments to the order, if any;
• User account identifier in the personal account, if applicable;
• information automatically obtained when using the Website and through analytics services, including the IP address, Cookies data, information about the User’s browser and device, technical characteristics of software, date and time of access to the Website, information about pages visited and the User’s actions on the Website.

3. Purposes of Personal Data Processing

3.1. The Company processes Users’ personal data for the following purposes:

• preparation, conclusion and performance of sales agreements for goods offered on the Website, including order placement and processing, User identification, arrangement of delivery, provision of order status information, and processing of product and payment refunds where provided for by applicable law;
• promotion of the Company’s goods, works and services through advertising and informational communications solely where the User has provided separate prior consent to such processing and to receiving the relevant communications;
• collection of statistical information regarding Website traffic, analysis of User behaviour and improvement of the Website through the Yandex Metrica service, based on the User’s consent to the use of the relevant Cookies and analytics technologies.

4. Legal Grounds for Personal Data Processing

4.1. The legal grounds for the processing of personal data by the Company are:

• the User’s consent to the processing of personal data where, under the legislation of the Russian Federation, such processing is carried out on the basis of the User’s consent;
• the necessity to process personal data in order to enter into an agreement at the User’s initiative and to perform an agreement to which the User is a party;
• the necessity to process personal data in order to fulfil obligations imposed on the Company by the legislation of the Russian Federation;
• the User’s prior consent where personal data is processed for the purpose of direct promotion of goods, works and services through means of communication;
• the User’s consent to the use of the relevant Cookies and analytics technologies, expressed through the action provided on the Website, where information is processed using the Yandex Metrica service.

5. Conditions for Processing and Transfer of Personal Data

5.1. The Company undertakes to use the User’s personal data solely for the purposes specified in Section 3 of this Policy.

5.2. Users’ personal data is processed using automated means, including within personal data information systems. Personal data is processed and stored for no longer than is necessary for the purposes for which it is processed, unless a different retention period is required by the legislation of the Russian Federation or by an agreement. Once the purposes of processing have been achieved, the need to achieve such purposes has ceased, or other grounds provided by law have arisen, the personal data shall be destroyed or anonymised in accordance with the procedure established by applicable law, unless there are lawful grounds for its further processing and storage.

5.3. Users’ personal data shall remain confidential. The Company shall not disclose personal data to third parties or distribute such personal data without the User’s consent, unless otherwise provided by federal law.

5.4. The Company may provide the User’s personal data to third parties only to the extent necessary to achieve the purposes of personal data processing specified in this Policy, including:

• delivery and transportation providers, including CDEK, to the extent necessary for arranging, transporting, delivering and tracking an order;
• payment services, banks and other organisations involved in processing payments and refunds, to the extent necessary to carry out the relevant transactions;
• YANDEX LLC when using the Yandex Metrica service for the purposes of collecting Website traffic statistics, analysing User behaviour and improving the Website, provided that the User has consented to the use of the relevant Cookies and analytics technologies;
• authorised government authorities in the cases and in accordance with the procedure established by the legislation of the Russian Federation;
• other persons where such transfer is necessary for the performance of an agreement with the User, fulfilment of the Company’s obligations imposed by the legislation of the Russian Federation, or is carried out on another lawful basis.

Where the Company engages persons to process personal data on its behalf, the Company ensures compliance with the requirements of the legislation of the Russian Federation on personal data. The Company does not sell Users’ personal data or distribute it to an indefinite number of persons.

6. Rights of the Personal Data Subject

6.1. The User, as a personal data subject, has the right to:

• obtain information concerning the processing of their personal data in the cases and in accordance with the procedure established by the legislation of the Russian Federation;
• request clarification, blocking or destruction of their personal data where such data is incomplete, outdated, inaccurate, unlawfully obtained or no longer necessary for the stated purpose of processing;
• withdraw previously provided consent to the processing of personal data by sending a corresponding request to the Company’s postal address or email address specified in Section 9 of this Policy;
• contact the Company regarding the processing and protection of their personal data and exercise other rights provided for by the legislation of the Russian Federation.

Where the User withdraws consent, the Company shall cease processing personal data carried out on the basis of such consent. Where other lawful grounds provided for by the legislation of the Russian Federation exist, the Company may continue processing the relevant personal data without the User’s consent.

Where retention of the personal data is no longer necessary for the purposes of processing and there are no other lawful grounds for its continued processing and storage, such personal data shall be destroyed within a period not exceeding 30 (thirty) days from the date the withdrawal is received, unless a different period or procedure is provided for by the legislation of the Russian Federation, an agreement or another arrangement with the User.

7. Personal Data Protection Measures

7.1. The Company implements the necessary legal, organisational and technical measures to protect Users’ personal data against unlawful or accidental access, destruction, alteration, blocking, copying, provision, distribution and other unlawful actions.

The Company has appointed a person responsible for organising the processing of personal data. Access to personal data is restricted and is granted only to persons who require such access to perform their duties. Access to information systems and the administrative section of the Website is provided through user accounts and passwords and is subject to access-right restrictions.

A secure HTTPS (TLS) connection is used when data is transmitted through the Website. The Company implements organisational and technical measures aimed at preventing unlawful or accidental access to personal data and monitors compliance with the requirements of the legislation of the Russian Federation on personal data.

8.2. The Company may amend or supplement this Policy in connection with changes in the legislation of the Russian Federation, the procedures for processing personal data, the information systems and services used by the Company, or in other necessary circumstances. A new version of the Policy shall take effect from the moment it is published on the Website, unless otherwise provided by the new version of the Policy.

Where the relevant changes require the User’s consent to the processing of personal data, such consent shall be obtained separately by the Company in accordance with the legislation of the Russian Federation.

8.3. This Policy and the relations between the User and the Company arising from its application shall be governed by the laws of the Russian Federation.
